Indian Gaming has been one of the most controversial issues in Indian
Country for many years, even more so since Congress passed the Indian Gaming
Regulatory Act (IGRA) in 1988. Indian Gaming is intertwined with virtually
every aspect of Native American life in the 20th and 21st century.
This presentation is going to give an overview of the political
circumstances and legal decisions which form the basis for Indian Nation
Government Gaming, put Indian Gaming into the economic context of the
American gaming industry and show how some tribes have embraced gambling as
a form of generating tribal revenue while others choose not to.
Special attention will be directed towards two issues:
The concept of tribal sovereignty ("domestic dependent nations") and its
erosion through legislation regulating Indian Gaming and taxation of tribal
moneys.
The impact of Indian Gaming on the process of Federal Recognition
("Procedures for Establishing that an American Indian Group Exists as an
Indian Tribe").
